Derivative action against Apple must be judged against current board

In a derivative shareholder lawsuit, when analyzing an amended complaint whether the prerequisite demand of board of directors is futile, the trial court must look at the board composition at the time of amended complaint, not the composition of the board at the time of the original complaint.
