Deposition

A deposition is a discovery tool.  A deposition is an interview under oath of a party or a witness.  In general, parties are entitled up to ten depositions per federal law suit.  Each deposition can be scheduled for up to eight hours.  The person being questioned takes an oath, under the penalty of perjury at the start of the deposition.  In general, the deponent or the deponent’s attorney can object to any question during the deposition in order to preserve that objection.  However, in general, the deponent still must answer the question.  If the deponent or attorney fails to object, such an objection will likely be waived, and unavailable at trial.
